I’ve been doing the Lehto’s Law podcast now for over half a year and I thought, “I wonder if anyone wants to know what a podcast looks like?” You know like, “What does a movie taste like?” Or, “How does a painting sound?”

Actually, someone told me they listened to podcasts on Youtube. Really? But what do you look at when doing that? Turns out it’s like those “videos” for songs I listen to when someone puts up a song with a photo as filler. Not sure why I hadn’t thought of that.

Well, I couldn’t ask anyone to look at a picture of me for 18 minutes, so I decided to film a podcast - and record it too, the old fashioned way. This week’s Lehto’s Law is on the topic of Arbitration and why you want to avoid it (it’s episode #35 for those of you who are trying to collect the whole set). It is thus available as a thing you can watch.

Very good post. I have read about the problems with binding arbitration before, but hearing real world examples bring it home. I thought I read that there was going to be legislation to reign in abuses, am I imagining that?

As always, very educational. One item I’d like to know more about is where the arbitrators come from. You said that in one case they were (I assume retired) former executives of a company forcing binding arbitration for their customers. Is this typical?

As a follow-on question, is there any kind of training and/or certification for arbitrators? I imagine there’s a “Miss Manners School of Binding Arbitration” and/or some kind of wall candy you — as an arbitrator — can hang up to look Impressive and Professional. Or do you just cook something up in Word and have it framed?

Great video. I’d watch these if you put ‘em up on a YouTube channel.

Hey Steve. This is off topic, but there was a thread a day or so ago on oppo about someone hiring a (now infamous) shop to do some work on his car. Their have been many unreasonable and unexplained delays, the work was never done and the car still remains at the shop a year and some change later in an unknown state of repair. What legal options exist for the car owner in this position?

Great post and great podcast. Perfect timing too. I am a member of a Jeep Renegade forum (I don’t own one yet). A lot of folks there are experiencing problems with their brand new cars and have been talking about invoking lemon laws in their states. I’ve shared this over there for those pondering this path.

Interesting episode. So, on the whole, you don’t think arbitration is a better option than courts? My impression of the court system is that it takes longer and costs much more. I have no experience either way, but are the examples you use here common enough that you would rather go to court? If you did agree to an arbitration clause, would it not be sufficient to eliminate phrases saying “we make the rules and choose arbitrator?”

It really depends on what kind of arbitration you get roped into. But notice that consumers never clamor to get into arbitration. Who cares if it’s faster if it’s slanted in favor of your opponent?

In reverse order: I have a youtube channel and will be adding more of these as time permits.

The problem with the arbitrations is that some are run one way, some are run another. I have seem them where the arbitrators are neutral and trained. I’ve seen others where the arbitrators are obviously biased and there was no mention of training.

Good advices as always. Sounds as if a lot of arbitrators are graduates of the Close Cover Before Striking School of Law (and Taxidermy).
